Algonquin Power & Utilities Corp. and its affiliates and subsidiaries, which include those entities forming part of the Liberty Utilities Group (collectively referred to as "Algonquin”, "we”, "us” or "our"), are concerned with your privacy and want you to be familiar with how we collect, use and disclose personal information. This Privacy Policy describes what personal information Algonquin collects, uses, discloses, retains or otherwise processes in connection with our products and services, including through Algonquin’s websites (where this Privacy Policy is displayed), as well as offline, such as when you ("user", "you" or "your") apply for or use our products and services, or otherwise interact with us. The Algonquin entity that you interact with controls and is accountable for your personal information. This Privacy Policy does not apply to personal information relating to our employees.
By accessing or using our products and services, including our websites, or otherwise providing us with your personal information, you acknowledge that you have read and understood this Privacy Policy and, to the extent permitted by applicable law, your use of our products and services constitutes your agreement and consent to the provisions of this Privacy Policy and our Terms of Use.
Personal Information we collect
For purposes of this Privacy Policy, "Personal Information" is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a natural person or household. What is defined as Personal Information may vary depending on the laws of the jurisdiction in which you reside.
We may collect Personal Information about you when you access or use our products and services, or when you directly provide it to us. The specific Personal Information we collect varies depending on how you interact with us.
Personal Information you provide to us
We collect Personal Information that is necessary to provide you with our products and services, including for the purposes described in the “How we use your Personal Information” section below.
This Personal Information may include:
- Contact information, such as your name, street address, email address or phone number (mobile, business, or personal);
- Login credentials, such as usernames, aliases or passwords used to access your online account;
- Government-issued and personal identifiers, such as your date of birth, Social Security Number (for US residents), driver’s license or state identification number, passport or permanent resident (green) card information (which may include a copy of the identification document), taxpayer identification number;
- Financial and account information, such as credit history information, payment card information or banking information;
- Demographic or profile information, employment information, creditworthiness or geographic location;
- Veteran or active-duty military status.
Some of the Personal Information we collect may be considered “sensitive personal information” under applicable privacy laws. This may include information that reveals your, mental or physical health condition or diagnosis, or citizenship or immigration status (for example, as reflected in identification documents you provide). We process such sensitive personal information only as permitted by law and for purposes necessary to provide our services, comply with legal obligations, or support other legitimate business purposes.
We may collect Personal Information when you participate in market research, visit, register for or access your online account, fill out a form or sign up for alerts or notifications, submit an application for employment, engage with us during open houses or other public consultation forums or otherwise communicate with us or our representatives (for example, when you report an emergency or service issue).
Personal Information from third parties
To the extent permitted by law, we may collect or purchase information from third parties, including marketing companies, digital advertising agencies, third-party ad servers, third-party email servers, data aggregators, analytics providers or third-party advertising networks.
Personal Information we collect automatically
We automatically collect certain information about your interactions with our websites and services using cookies, web beacons, pixels and similar tracking technologies. These technologies help us improve user experience, analyze website performance and deliver relevant content and advertisements, including targeted advertising. For example, we may use tools such as Google Analytics to analyze usage patterns and improve our services.
Some tracking technologies may allow third parties to collect information about your online activities over time and across different websites. We use these tools only to analyze aggregate usage trends and do not use session replay or similar technologies that record individual interactions with our website, such as keystrokes, mouse movements, or scrolling behavior.
Cookies: Cookies, pixels or other tracking technologies are small data files placed on your browser when you visit a website. Cookies store a unique identifier that sends back a signal to the installer of the cookie to recognize your browser and track your activity on the website that installed the cookie and, in some cases, across other websites. There are many different types of cookies that perform different functions, such as keeping you logged in, recording your preferences and facilitating transactions. Cookies do not identify you personally, but can be used to recognize your browser.
We and our third-party partners may use cookies and similar technologies to deliver more relevant content and advertisements, including targeted or interest-based advertising, based on your interactions with our websites and other online services.
Depending on the jurisdiction from which you access our services, you may be presented with a cookie banner and consent tool that allows you to manage your cookie preferences. Most browsers also let you manage cookies, including declining them, through your settings. The "Help" tab on your toolbar may guide you to the settings for your browser that allow you to change your preferences regarding cookies. If you decline cookies, the functionality of our websites may be impaired.
Web beacons: A web beacon is an object embedded in a web page or email that is usually invisible to the user and allows website operators to check whether a user has viewed a particular web page or email. We may use web beacons on our websites and in emails to count users who have visited particular pages or viewed emails, and to deliver co-branded services (where legally permissible). Some web beacons can be rendered ineffective by declining certain cookies or modifying your browser setting to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis. Depending on the jurisdiction from which you access our services, you may also be able to manage web beacons through a consent tool.
IP addresses: Your IP address is automatically assigned to your computer by your Internet Service Provider and is identified and logged automatically in our server log files whenever you visit our websites, along with the time of your visit and the page(s) you accessed. We use IP addresses for purposes such as calculating website usage levels, diagnosing server problems, administering the website and presenting content.
Other automatically collected information
For existing customers, we may automatically collect billing information such as payment history and assessments, as well as data regarding historical meter readings and consumption patterns.
When you contact us via telephone, we may record the conversation for quality assurance, training and record keeping purposes, and such recordings may be conducted by or shared with our authorized service providers who assist us with customer support.
Where the information we collect automatically is not Personal Information, we may use and disclose it for any purpose. If we combine this information with Personal Information, or if this information is considered Personal Information under applicable privacy laws, we will treat it as Personal Information in accordance with this Privacy Policy.
We may combine Personal Information that you provide to us directly with the information we collect about you automatically and from third parties. We will treat the combined information as Personal Information and use and disclose it in accordance with this Privacy Policy.
How we use your Personal Information
We may use Personal Information we collect from you to:
- Provide the products and services that you request, or obtain products, services or rights from you, including to administer any account or agreement that you have with us.
- Determine your eligibility for services, including for discounts and customer programs, and ability to pay for such services.
- Bill and collect payment for products and services we bill you for.
- Notify credit reporting agencies and collection agencies if your account is designated for collection.
- Respond to outages or other emergencies and assist first responders in situations of immediate threat to life or property.
- Provide rebates, refunds or credits for usage or programs offered by us.
- Understand your needs and preferences so as to provide you with better services.
- Provide customer service, including responding to your inquiries and fulfilling your requests.
- Process and evaluate employment applications and communicate with you about recruitment opportunities.
- Send you important information regarding Algonquin, our services, the websites or other administrative information.
- Send you marketing communications that we believe may be of interest to you.
- Allow you to communicate and interact with us through the websites or otherwise.
- Permit you to register and participate in forums and other events with Algonquin.
- Measure and improve our services and the content and layout of our websites.
- Conduct testing, research, analysis and product development.
- Address any claims you may have against Algonquin.
- As we believe to be necessary or appropriate to: (a) comply with legal obligations, regulatory requirements, and applicable law, including laws outside your jurisdiction of residence; (b) comply with legal processes; (c) respond to lawful requests from public and government authorities including public and government authorities outside your jurisdiction of residence; (d) enforce Algonquin's terms and conditions; (e) protect Algonquin's operations; (f) protect the rights, safety or property of Algonquin, you or others; and (g) allow Algonquin to pursue available remedies or limit the damages that we might sustain.
How we disclose your Personal Information
We may disclose your Personal Information:
- To Algonquin's third-party service providers who provide services such as website hosting, data analysis, payment processing, program enrollment, infrastructure provision, IT products and services, customer service (including support handling inbound service calls), email delivery services, market researchers, auditing services and other similar services, including support for the sale, fulfillment, distribution and marketing of Algonquin products and services.
- To credit reporting agencies and collection agencies to notify them if your account is designated for collection.
- In connection with, or during the negotiation of, any corporate reorganization, dissolution of all or a portion of our business, merger or acquisition, divestiture, sale of company stock or assets or financing.
- As we believe to be necessary or appropriate to: (a) comply with applicable law, including laws outside your jurisdiction of residence; (b) comply with legal processes; (c) respond to lawful requests from public and government authorities including public and government authorities outside your jurisdiction of residence; (d) enforce Algonquin's terms and conditions; (e) protect Algonquin's operations; (f) protect the rights, safety or property of Algonquin, you or others; and (g) allow Algonquin to pursue available remedies or limit the damages that we may sustain.
- To other parties when you have provided your consent or as otherwise permitted or required by applicable law.
Third party collection of Personal Information about your online activities over time and across different websites
Certain third parties, including service providers acting on our behalf, may collect information, including Personal Information, about your online activities on our websites and on and across different websites before you enter and after you leave our websites. We engage service providers to perform these activities on our behalf subject to contractual restrictions that limit their use and disclosure of Personal Information, and such processing is covered by this Privacy Policy. Other unaffiliated third parties may also collect or track information about your online behavior across the Internet and over time for their own purposes. This Privacy Policy does not apply to information collected by such unaffiliated third parties.
Links to third party websites
Our websites may contain links to other websites which are owned and operated by unrelated third parties. Please be aware that we are not responsible for the content or privacy practices of such other websites or third parties. We encourage our users to be aware when they leave our websites and to read the privacy statements of any other websites that collect Personal Information.
Security
Algonquin uses reasonable organizational, technical and administrative measures to protect Personal Information under Algonquin's control. Access to Personal Information is limited to authorized employees and service providers who require access for the purposes described in this Privacy Policy. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with Algonquin is no longer secure (for example, if you feel that the security of any account you might have with Algonquin has been compromised), please immediately notify Algonquin of the problem by contacting Algonquin in accordance with the "Contacting Algonquin" section below.
Your privacy rights and choices
Depending on the jurisdiction in which you reside, you may have certain rights regarding your Personal Information. This section describes the rights you may have and explains how to exercise those rights.
- Right to know/access/portability
You may have the right to request access to the Personal Information we have collected about you and to obtain details about how we collect, use and disclose that information for at least the 12-month period preceding your request. Where permitted by law, you may also request information collected beyond that 12-month period. Once we receive and confirm your request, subject to any exceptions provided by applicable law, we will disclose the information you requested, which may include:
- The categories of Personal Information we collected about you.
- The categories of sources for the Personal Information we collected about you.
- The specific pieces of Personal Information we collected about you.
- The purposes for which we collect and use that Personal Information, including business or commercial purposes.
- The categories of third parties with whom we share that Personal Information.
- If we disclosed your Personal Information for a business purpose, a list identifying the categories of Personal Information that were disclosed to each category of third party.
You also have the right to request that we provide your Personal Information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another entity.
- Right to correct
You may have the right to request that we correct inaccurate or out of date Personal Information that we maintain about you. Once we receive and verify your identity, we will use commercially reasonable efforts to correct or update the information in accordance with applicable law.
- Right to delete
You may have the right to request that we delete any of your Personal Information that we have collected, subject to certain exceptions. Once we receive and confirm your request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.
- Right to opt out sale or sharing
Certain applicable laws may provide consumers with the right to opt out of the sale or sharing of their Personal Information, as those terms are defined under applicable laws. Algonquin does not sell Personal Information for monetary consideration. However, we work with third-party service providers, including an advertising agency and analytics providers such as Google Analytics, that may collect or receive information about your interactions with our websites and other online services for purposes that may include targeted advertising. In some cases, this may be considered a “sharing” of Personal Information under applicable laws. If you do not want us to share your Personal Information for such purposes, you can limit such sharing using the tools described in the “Personal Information we collect automatically” section above, by adjusting your browser settings to block cookies, or by enabling the Global Privacy Control signal in your browser, which Algonquin recognizes and honors as a valid opt-out request.
- Right to opt out of profiling
Certain applicable laws may provide consumers with the right to opt out of certain profiling relating to automated processing of Personal Information that produces legal or similarly significant effects concerning the data subject. Algonquin does not engage in this type of profiling or automated decision-making that produces legal or similarly significant effects on individuals.
- Right to withdraw consent or limit processing of sensitive Personal Information
You may have the right to withdraw your consent to our collection, use or disclosure of your Personal Information at any time, subject to contractual or legal restrictions.
In some jurisdictions, applicable laws may also provide consumers with the right to limit the use and disclosure of sensitive Personal Information. Algonquin does not use or disclose sensitive Personal Information for purposes other than those necessary to provide services, maintain security, or comply with legal obligations. As a result, this right does not apply.
- Right to non-discrimination
We will not discriminate against you for exercising any of your rights. Unless permitted by applicable law, we will not:
- Deny you products or services.
- Charge you different prices or rates for products or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of products or services.
- Suggest that you may receive a different price or rate for products or services or a different level or quality of products or services.
Exercising your rights
To make a request to exercise your rights described above, please contact us using the information in the “Contacting Algonquin” section below.
Only you, or someone legally authorized to act on your behalf, may make a request related to your Personal Information. We may deny a request if the requestor is not entitled to such rights under applicable law or where an exception applies under applicable law.
Depending on the jurisdiction in which you reside, you may be limited to no more than two Personal Information requests within a 12-month period. To help us process your request, please:
- Provide sufficient information to allow us to reasonably verify your identity or authority to act on behalf of the individual whose Personal Information we collected, and
- Describe your request with enough detail to allow us to properly understand, evaluate and respond to it.
We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm that the Personal Information relates to you. Making a Personal Information request does not require you create an account with us. We will only use Personal Information provided in the request to verify identity or authority.
Response timing and format
We endeavor to respond to Personal Information requests within the time period required under applicable law. Depending on the jurisdiction in which you reside, this period is generally between 30 and 45 days from receipt of your request. If we require more time, we will notify you of the reason for the delay and the extension period in writing, either by mail or electronically, based on your preference.
Any disclosures we provide will cover the 12-month period preceding the date we receive your request. The response will also explain the reasons we cannot comply with a request, if applicable.
We do not charge a fee to process or respond to your Personal Information request except as permitted by applicable law. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Right to appeal
Depending on the jurisdiction in which you reside, you may have the right to appeal our decision if we deny your request to exercise any of the rights described above. To do so, you can reply directly to our decision or contact us at privacy@libertyutilities.com. We will inform you in writing of the outcome of your appeal, including an explanation of our decision. If your appeal is denied, we will also provide information about any available method to submit a complaint or inquiry to the relevant regulatory authority.
Promotional communications
You may opt out of receiving promotional messages from us by following the instructions in those messages. If you decide to opt out, we may still send you non-promotional communications, such as communications about your settings, your account, outage or emergency alerts.
Do Not Track and Global Privacy Control
Most web browsers and some mobile operating systems include a Do Not Track ("DNT") feature or setting to signal your preference not to have your online browsing behavior monitored and collected. Our websites currently do not respond to DNT signals or mechanisms.
Certain browsers and extensions support the Global Privacy Control (“GPC”), which lets users signal a preference to opt out of the sale or sharing of their Personal Information. Under applicable laws, businesses are required to treat valid GPC signals as opt-out requests. Algonquin will comply with this requirement and honor GPC signals in accordance with applicable law.
Retention period
We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by applicable law. Your Personal Information may be processed and stored, including by our service providers, outside of the jurisdiction in which you reside.
Children
Our products and services are not targeted or directed at individuals under the age of 18. Our websites are general audience sites that are not designed nor intended to collect Personal Information from individuals under the age of 18. We do not knowingly collect such information, and if we become aware that we have done so, we will promptly delete it.
California users
California Civil Code Section 1798.83, also known as the California "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about the Personal Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of Personal Information that was shared and the names and addresses of all third parties with which we shared Personal Information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing using our contact information in the “Contacting Algonquin” section below.
Changes to this Privacy Policy
We may change this Privacy Policy. Please review the "Approval Date" at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the website. If the changes are significant, we may provide a more prominent notice (including, for certain services, email notification of privacy policy changes). Your use of our products and services following any changes to this Privacy Policy constitutes your acceptance of those changes.
